2. Scope of Policy
This document governs data practices across all pages hosted under our domain (apexnews.co.ke), including newsletter subscription blocks, member portals, and general service pages. It details how user records are archived in compliance with the Kenya Data Protection Act, 2019.
3. Data We Collect
We log two distinct formats of user records depending on platform interactions:
- Voluntary Records: Contact details such as name, email addresses, cell numbers, and custom messages provided when completing lead forms or subscribing to news alerts.
- Automatic Technical Logs: Analytics parameters including raw IP addresses, basic browser types, unique device tags, general regional locations, and timing statistics logged via essential or optional tracking scripts.
4. Purposes and Legal Bases for Data Processing
| Purpose of Recording | Data Category Used | Legal Basis (Kenya Data Protection Act 2019) |
|---|---|---|
| Administering digital news subscription profiles | Email, billing details, names | Contract execution / Consent agreements |
| Sending daily regional bulletins | Email addressed, categories selected | Opt-in Consent |
| Mapping editorial readership traffic metrics | Anonymized IP logs, browser headers | Consent / Legitimate business interest |
5. Cookie Preferences & Google Consent Mode v2
We deploy Google Consent Mode v2 (advanced modeling). Non-essential tags (e.g. tracking and marketing blocks) remain disabled until you select "Accept All" or enable specific toggles inside our Cookie Settings panel. Selected choices are preserved locally on your hardware. You can adjust selections at any moment by clicking "Cookie Settings" positioned in our site footer.
6. Data Retention Policy
We preserve reader records only for the duration required to satisfy active subscriptions or investigate reported editorial errors. Standard marketing logs are archived for no longer than 24 months before irreversible purging processes run.
7. User Rights and Our Regulatory Body
Under the Kenya Data Protection Act 2019, users have direct rights to access personal records, request corrections, ask for purging, or contest automated decisions. If you suspect your user records have been handled inappropriately, you have the statutory right to alert the Office of the Data Protection Commissioner (ODPC) in Kenya via their digital query lines. All formal operations under this policy align with the courts and jurisdiction of Nairobi, Kenya.
8. Children's Protection
We do not purposefully archive personal information from kids under the age of 13 in Kenya. If structural audits identify that children's credentials have been compiled without parental oversight, they are permanently purged from our storage arrays immediately.
